Is calling a patients emergency number to have patient call us back a HIPAA violation?
i was terminated as biller because it was said that I called patients emeg.
number, who was her sister and told her that if the patient didnt call us ASAP she would owe us alot of money. All we needed was updated insurance information, I knew the insurance was going to pay. I would never had said that . What information can you ask emergency contact numbers. Cant they be used by collection agencies? I believe I was terminated unjustly, been billing for 12 yrs???
If you did not say that and had the experience of 12 years, you should not have been terminated. However, asking what info you can say to emergency contacts makes me wonder just how much knowledge you have in this area.
Emergency contacts are meant just for that- Emergencies.I'm sure that person gave that persons name as a contact while a patient. The FDCPA (fair debt collection practices act) prohibits disclosure of monies owed to anyone but who owes it. You may only talk to the debtor or debtors spouse- not family, neighbors, or friends. UNLESS, the patient/debtor gives written premission of another.
It sounds to me as if you are working in medical collections compared to billing.
