    Is it fair use to quote from a speech in a book?

    I'm working on a book and want to include some quotes by historical figures and authors. I know some quotes are fair use but I was wondering whether quotes from history are considered fair use. I'm trying to figure out what is legal to use and how to determine if its fair use.

    It's generally something to be avoided - quoting that is. Speeches *might* be considered public domain material since it was written for the public and is already largely quoted by the press but it was still written by someone and may have copyright issues. After all you may profit from your book and living people will want to take their slice of the pie. You could just quote things that are very old and have no living witnesses or you could learn how to give credit to and when and how you need to do that. Also it does sometimes make a difference if this is a research or reporting piece compared to something like historical fiction. Not sure what you're going for. You may want to speak with a copyright lawyer to learn the finer details of this issue - they'd be able to clarify, I'm sure.

    You can use quotes as long as you give the title of the book and the author who originally wrote it.  If you present it as your work without giving due respect you would be bordering on plagiarism.  Also you cannot use a large excerpt - make it small as possible (use it as reference).

      I agree with Carbqueen.  Give credit to your source.  Keeping it to excerpts is best when it comes to speeches.  If in doubt, send the speaker or source an email asking permission.
