Is a marriage proposal a contract?
Man Must Pay $50,000 After Breaking Engagement to Fiancée

On Dec. 23, 2004, Christopher Ned Kelley gave Melissa Cooper a ring valued at about $10,000. Since 2000, Kelly, had lived with Cooper, who also had a child with him. after the proposal, she learned that Kelley had been in a (two-year relationship with another woman) that began before the proposal. In April 2011, when Cooper confronted him about a relationship with yet (another woman), he told her that he wanted to be with that woman. Court of Appeals of Georgia ruled "the promise to marry is enforceable". Why she never dumped (him) is a mystery. If things were reversed would a man get $50k?

The Breach of Marriage Promise is an old common law tort that evidently Georgia still has on the books (or at least doesn't prohibit). It is kind of an odd one. I don't know if it goes both ways today. Originally it was meant to protect woman, since she was the one who would end up with her suitability as a wife tarnished. We don't really worry about those sorts of things today.

I can remember hearing if a woman calls off the wedding she should give back the ring and if the man calls off the wedding he shouldn't expect the ring back. In this case I can see the court granting child support but no money for breaking up.

If there are any men who are "afraid of commitment" this likely to keep even more of them from proposing! :-)
