Legalities of using a photograph published in National Geographic whether on their webpage/magazine

What are the legalities to uploading a national geographic photograph with photographer listed. Do I ask him or her for permission to use their photo and if so, how do I do that

The legalities are if you don't have permission from the person who owns the rights to the photo, you don't have the rights to use it.

You will have to find out how to contact the specific photographer whose picture(s) you want to use.  They will be able to tell you if you can use the picture and if any payment is required or if you need to credit them.

I would stick to free or open content if possible.

If you want to ask permission, just fire out an email.  Sometimes they will let you use it without needing to pay anything so long as you cite where it is from (give credit).  Also, be prepared to answer why you are using it.
