Should I have my property surveyed and marked before or after my neighbor builds a fence?
Last night I mowed my backyard as it was getting dark. My neighbors went out last night after dark and placed property line markers where they think the property lines are. They left a note in my mailbox indicating that a professional surveyor marked the property lines and that they are putting in a privacy fence between our properties. I have spoken directly to this neighbor twice in the three years I have been in this neighborhood. His family and his three dogs are in my yard several times a day, yet he is putting up a fence for privacy.
Ok from a real estate agent view I would say yes, you should go ahead and get your property surveyed just to be on the safe side if you feel the fence may be on your property. From a personal aspect I would think you would be happy about the privacy fence. As a dog owner we have a privacy fence to keep the dogs both contained and from being able to see the neighbors as much. If they don't see the neighbors they are less likely to bark.
I would have it surveyed before the fence goes up - just in case his markers are wrong and you want to protest.
Otherwise if his dogs spend time in your yard, I would be grateful for the fence going up...as long as it is not on your property.
Did they say who the surveyor was? Do you trust these people? Do you care? If your answer to the questions were No, No, Yes. I would get me own surveyor.
Are you unhappy at where the boundary has been marked? Does it seem reasonable and where you would expect it to be? If so, then you may not wish to incur the expense of getting the land surveyed also.
However, if you can afford it, then it would be prudent to arrange for your own surveyor to confirm the location. You can always put a note in your neighbours mail box thanking them for the information but requesting that they don't proceed with any work until this has been undertaken.
You may also want to add that you have no objection to the fence being erected and that it is purely a matter of obtaining an independent assessment of where the boundary lies.
To be honest, I am surprised that you have tolerated this situation for so long. I suspect that your neighbour may have received some complaints about his dogs possibly? Not sure what powers the authorities have in your area but 3 dogs should never have the freedom to roam outside of his boundary, regardless of their species.
