I believe the law states that a child has to live with you at least six months out of the year in order to have the right to claim him/her on your taxes. If you do claim the baby on your taxes make sure that the baby is not claimed by anyone else on their taxes. However two people can claim the same child on their taxes if they claim them only for that six month period, otherwise it is illegal. Hope this helps.
