No need to file a DMCA claim if content is no longer online

Today I received another RED copyright notice on an old hub, "The First Signs of Urticaria" and I followed the link to the alleged site in violation. What I found was an Advertisement (very lengthy) selling a product to get rid of hives. I looked around and couldn't find any evidence that they have copied my article in any way, although there are pages and pages of testimonials about the "wonders" of their product. When I tried to leave the page it made me refuse to order the product 3 times before it would close. Apparently their site is promoted out of Clickbank.

What am I supposed to do to get rid of this "violation" on my hub? I can't file a DMCA against someone who hasn't copied my hub.

    sad

      Peg,

The message is not a "violation" but simply an informational message letting you know that your Hub had been copied.
It appears after the system found the content, the URL was unpublished.
In this case, it appears there is no content about which you can file a DMCA claim, but it could be they are having server issues and the content could show up on that URL again later.

You can disregard this informational message if you would like as it has no effect on your Hub.

Thank you, Matthew, for clarifying this. I appreciate your explanation of the notification and just wanted to clear up anything that needed my attention. This makes me feel a lot better about seeing RED.

Matthew, I recently took extracts from a number of my hubs and found that around 10 of them had been copied by various blogs and sites. However, I've never had that red copyright notice to tell me it was happening. So, is this system efficient, and can it be improved? For the moment I might resort to using google alerts, but it would be nice if hubpages told me.

HubPages' checking system isn't run for every Hub, only on those with high traffic.

The reason is that HubPages uses a third party service which is expensive.  For the same reason, they can't afford to run it frequently.

My highest traffic hub was copied twice since it was published 3 months ago. Luckily for me, it was a viral hit that has received 178k views on HP. Most of those views came near the start, and the thieves also took it around 2 months ago. So the hub should be high traffic, and it was copied long ago. Perhaps I'm not seeing this notice... does it appear on the accounts page, the hub itself, or in edit mode? Still, I think I would have noticed it, especially if it was on the accounts page. I always keep an eye out for notices like "broken links".

It appears on your account page.

I didn't express myself well in the original email.  What I should have said was, only on Hubber accounts with high traffic overall - and I have a feeling it might be total traffic, not current traffic, because I see some people still getting checked who aren't very active these days.  So for instance, mine still get checked because I'm heading for 2 million views, even though I don't have a large number of Hubs these days.

Ah I see. Well I only have about 400k hits in total for my account, so maybe that's it. I've set up a number of google alerts using quoted sentences from my best hubs. Hopefully that will catch them in future.

I need to set up some Google alerts. I'm battling more of the copy cat issues than ever before.

I also have red copyright notices on several hubs that were copied, but I contacted the people and the content (my content) was removed from their sites about six months ago. I guess we have to live with the red C's forever.

            Marisa,
Maybe they should move the "Copyright by PegCole17 2009" (example) notification found under display options to the top of the page. That might discourage some of the offenders who copy and paste.

          Hi Thomas,
It doesn't seem too prompt. It took almost 3 years for the copyright symbol to show up on the hub in MyAccounts page. The offending site has had my work out there since 2011.

It's an annoying situation.  It's happened to me, too.  What someone has done is create a site using your  text, then redirected that site to an advertisement for a related item.  Because you can't see the intermediate site there's nothing you can do, as far as I know.

        Hello Marisa,
Thank you so much for explaning this. I couldn't figure out the relevance to my hub, other than the subject matter, but now I understand. Do we just live with the Red Copyright notice now or can something be done to sort out the offender?
Nice of you to respond to my rant. smile

You can't control the copyright notice. I still have the copyright symbol showing on Hubs where I managed to get the copy removed months ago.

            Hi Marisa,
Thankfully, I received word from Google that the offending web site is being taken down, so I'm not too bothered by the red symbol anymore.

I am embarrassed about misspelling the word "explaning" rather than "explaining". Oh fudge.

Hi,I have noticed your problem,if the fact is that capsules are only loading when you reload the page, then problem would be cookies.Hubpages uses cookies.Try to clear cookies by using alt+ctrl+del for firefox and chrome.Note that hubpages performs better in firefox than in chrome, safari and explorer.make it count.
    Happy hubbing.
