If u appeal a old drug case will the new laws apply to the sentencing?
Probably not.During prohibition those who were arrested for selling alcohol illegally were not released nor did they get their records exsponged once the laws changed and made selling alcohol legal.Punishment is normally based upon the law at the time of the crime.
Probably not -- the consequences of fascist laws are forever. However, Obama and/or various governors could issue mass pardons. Yeah, that'll happen.
Only if you have new evidence to present other wise you are bound by the laws that were standing at the time of the original arrest.
