Get a new boyfriend. Or a new phone. Then your answer is definitely "no".

Ya thanks for advice but I wasn't asking for any. I just want a knowledgeable answer.

If your boyfriend doesn't trust you why would you want to be with him? That's essentially what Jeramey is saying.
Clearly he's not the right guy for you. Unless you have been secretly doing dirt behind his back there's no reason to spy.

It sounds like there are trust issues on both sides.
You feel he doesn't trust you and has installed a spy app.
And you don't trust him to respect your privacy.
Trust issues usually arise when people break from established patterns/routines in a relationship or avoid giving direct answers.
Trusting someone doesn't mean you don't ask questions. It means you {believe} you will get honest answers to your questions!
There is no point in continuing a relationship with someone you don't trust. The goal is to establish a foundation of trust {before} deciding to become exclusive with someone.

Goals. We all have them. Sounds good but I'm 39. The history is...well blah blah blah. Thanks anyway

You're never to old to have a goal of being in a relationship that is based on love, honesty, trust, and respect.
Each of us gets to (choose) our own friends, lovers, & spouse
The world may not owe you anything but you owe yourself the world!

If there's a spy app on your phone, your data icon will indicate there is activity, even if you're not actively using data on your phone, because these apps need a constant connection to send all the information it's picking up. That's one key tell-tale sign.

Also if your phone is taking longer to shut off, turns on by itself, or runs really hot when you're not using it, these are also clues a spy app is running in the background.

Of course, the only way your boyfriend would have been able to install an app like that on your phone would be if he had your phone in hand and was able to use it for a period of time without your knowledge.

You can check your phone settings- under the running applications tab.
There are many system processes running but you can also find out some suspicious process being executed in the background.
