Can you legally post other people's youtube videos in your articles?

    Can you legally post other people's youtube videos in your articles?

    What are the ethics or licensing requirements for posting youtue video links in your articles?  I know how it works with photos/images online, but what about videos you find? Thanks!

    Technically, someone else's work, whether a photo, video, or writing belongs to them. They have copyright over it, whether they specifically say they do or not (in America anyway, other countries vary).

    Some people specifically waive or modify their copyrights, such as through Creative Commons license, which lays out the ways in which it is acceptable to use their work. Some people will say go ahead and do anything you want with it. If there is no specific copyright information than one must assume it is under copyright. Using it without permission, unless you believe it to be justified under a fair use principle, is wrong.

    Legality is a separate issue. It only really becomes illegal if you use someone's work and they then bring a suit against you, which they then would have to win. If you used the work under a fair use claim, they would have to also prevail against your defense. Fair use is a doctrine which allows limited use of a work without permission. Common examples include for education, news reporting, or criticism.

    Sharing Youtube videos is generally probably safe, because most people I think assume that their videos may be shared (and in many cases want them to be). Also, many people posting videos on Youtube don't have the ability to go around suing people who use their videos without permission. That doesn't technically mean it is right. It is always best to get permission.

      When someone uploads videos to YT, he/she can choose whether or not other people can embed them. If a YT video allows you to embed it, then it implies that the creator permits sharing.  Otherwise the creator will disable sharing/embedding.

    Videos that are on YouTube are able to be posted on your hubs. If it is a personal video that belongs to someone personally, you must have their permission. But, as far as anything on YouTube you can use it.

    This has always been a bit of a grey area. At one point even HP claimed that it's fine to embed YouTube videos. If the owner of the video didn't want you to, then they would disable the ability for people to embed that video. So by being able to embed a video, it is assumed that you're fine in doing so.

    Sounds silly, but it was in the FAQ or learning centre at one stage. I can't find it now though. Perhaps it was removed. smile

      That's right.  When you upload a video to YT you are asked if you want others to be able to embed it on their sites.  Disabling the embedding means that the video can only be viewed on YT.

    If a YT video has an embed code (click the "share" button) then the creator of the video consents to other people to embedding it on their sites.  If the creator does not want the video shared in that manner, then he/she will disable the embedding function. The upshot is that if you can grab the embed code, then you do not have to contact the creator for permission because the presence of the embed code is consent.

    Also, the ads that appear on the youtube video give money to the creators, not the hubpages user, so you don't have to worry about taking away anyone's ad money if you use their videos.
