    Have you ever had to evict a renter?

    Any advice for a first timer landlord? The house is in NC and the renter is  three months behind in rent.

    Laws vary among states.  There is a written notice which requires the landlord to give tenant x number of days to vacate.  If they don't there may be further steps such as court order and if they don't vacate then sheriff intervenes.

      I also add, by waiting to do anything, it can take up to a year, in court, to get them out.

    Yes I have, my first question is why did you allow it to get 3 months behind? You should have started the process immediately after the first month, more than likely you will not recover that money and will have to take the loss. Like LindaSmith said, each state varies, but I believe it can be anywhere from 3-10 days. Check with your Justice of the Peace/Sheriff

      I already have heard them all. I'm surprised the woman is still alive! And of course she wrote the wrong address on the last payment and it was returned to her.   :0

    The first advice is to never let a tenant get behind in rent after two weeks. The second advice is to Google web sites like www.mrlandlord.com and get familiar with renting laws in your state. The third piece of advice is to read the hubs here from other landlords and property managers. Good Luck!

    3 months is not at all acceptable. I completely agree with the others that you shouldn’t have allowed this much time. Actually most landlord make the mistake of not making a contract when the renter is taking hour house in rent. This allows them to take the chance. There are hundreds of incidences where the renter has fled away with a due rent of even 12 months! Yeah this is absolutely true. If you keep your goalpost open, you are bound to concede goals! So it is the responsibility of all landlords to make a legal agreement while giving the house in rent.

    Also the landlords should ask the renter for their personal documents such as identity card, driving license etc. This is to ensure that you are giving your house rent to a genuine person, not any fake identity. Also you can verify the identification by testing them in the local police station. If you are 100% confirm that the person is genuine then you are free of many risks. Even if the renter invades away anytime, you can take steps to catch him as you have all the documents in your collection. Without doing all this, giving rent is not free from risk.
