I wish that I could give you a simple answer to your question, but unfortunately no "simple" answer exists.
First of all, I hope that you aren't in a marriage that will end in divorce. Fight hard for your marriage!
As it pertains to your legal concerns, you should check with a qualified attorney about the issue. They would be the appropriate resource for legal advice.
Try to find a competent attorney, all attorneys are not the same caliber...
