    Is Oscar Pistorias guilty of premeditaed murder?

    Oscar Pistorias has been cleared of murder......is he lucky or what?

    He has been cleared of premeditated murder. But, the judge may vindicate herself by the time she sentencing him in prison. This man is 100% guilty of killing his girlfriend and should serve time in prison for doing so. It is my understanding that he still could be sentenced to 15 years in prison for what we call hear as manslaughter. What he deserves is life because that is what he took violently.

    I have no idea. I stopped keeping up with the trial some weeks ago when it started looking like a media shark banquet.

    One cannot convict an icon of something so low class as murder, the law is bent and twisted to keep images and uphold our heros and interenational demigods!

    Fact is, whether he is guilty or not, the STATE did not prove his guilt without a shadow of a doubt. The court works with facts and evidence. We all FEEL/believe, even know, he committed a horrible crime - even if he thought it was a burglar, his actions proved that he intended to kill. BUT, the court has to accept his evidence - that he did not plan per se murder - and consider the fact that he 'could have been' traumatized when he shot on impulse without contemplating the possible results. The court keep the constitution in mind, which state that every person has a right to be free, and therefore the court will not incarcerated a person if the evidence does not, without any doubts, indicates that the person is a danger to society. Oscar is lucky, he gets a second chance to prove himself as a good person and asset for SA. Whether he is going to succeed, we don't know. But he will live to the end of his life labelled as a 'man who had killed a beautiful woman', and his memories will never stop haunting him. We have to ask ourselves - supposed we were in his shoes, what would have been our feelings, hopes, etc....

      He still may very well be sentenced to time in prison for the crimes he has been convicted of. From my understanding he could serve 15 years.

      15 years is the minimum sentence for murder. Culpable Homicide could be  up to 15 years in prison, although there is no minimum sentence and previous cases have been punished with community service and fines. I don't think he will be jailed.

      Really? What a travesty. This is South Africa's OJ Simpson. It seems to be the case one can get away with murder if they have enough money in the United States and now South Africa. A normal citizen would be serving life in prison for this crime.

      Indeed, JThomp - Although OJ was more brutal, and his planning, too, exposed a criminal mind. Oscar doesn't have a criminal mind. He is simply... let me suffice it to say, too full of himself.
