States Can Opt-Out of Health Care

    There is a provision in the Health Care Reform Law that clearly and explicitly allows states to opt-out of the Federal Health Care System, and they can cancel the individual mandate if it suits them to do so. There is a catch. They have to set up a health care system that meets the standards and objectives of the federal health care system.

    So for all you conservatives who are gung-ho on 'real' health care reform, roll up your sleves and do it. No one is standing in your way, including the law.

      The law can go. Just a matter of time now. Screw them and thier... "Oh you can opt out. But you have to create a Law like the feds to do it."

      As I see it, the statute allows any state the right to do it better than the federal law - and opt-out of the federal law. However, letting people die for lack of health care because they can't afford insurance, and/or can't get it from their employer - doesn't qualify as doing it better.

      All the conservatives who had alternative plans that were cheaper, less intrusive and just better then 'Obamacare' can put up or shut up.

        Medicaid has long been in place, and could easily have been just broadened in income limitations to prevent these people you refer to who are dying for lack of health care, from dying.  Fairly simple, and did not require 1200 plus pages of legalease that in Biden's own words put the health care business under government control.

          So I suggest in your state you advocate to your state legislature that they open up the Medicaid program to accomplish a better result.  Then they can opt-out.  Don't you feel better?

                Currently, many States are highly financially challenged.  The health care bill creates even more financial burden via the expansion of Medicaid already, but that wasn't enough for this bribed and browbeaten Congress.

                The simple expansion of medicaid was apparently not enough to cover these folks not financialy able to buy health insurance --if you buy that as fact, which I don't -- but the alternative surely didn't require a treatise, and it is alarming to me, should be to everyone, this treatise which largely has nothing to do with the X millions you quote as not covered by insurance, and still aren't, given the delays built in to the health care bill.

                    Randy - You noticed the MO of Captain America. He/She/it thinks Health Care Reform should have been a simple expansion of medicad - but the states are to 'challenged' to accept the burden of Medicare.

                    He/She/it is opposed to the Health Care Bill ( but won't come out and say it) so the argument that the benefits that it opposes completely - will be delayed in being implemented.

                    Pure sophistry.

    This is actually pretty interesting, it could help move certain states up to international western healthcare standards if they choose to do so.  I have not been too sure of the insurance credits scheme, which seems like a lot of red tape.

    But this legislation clearly provides an oporunity for state by state national healthcare.

    Come on America, catch up with the rest of the world and give your citizens healthcare!

    Catch cancer early, prevent contagious desease outbreaks, help people find out they are ill before it is too late all with early detection!

    Some conservatives seem to think that liberals are fixed on eliminating state's rights. I don't see it that way, as this provision of Health Care Reform shows. There is a State (Hawaii) who has had a working health care system for decades that provides near-universal coverage. Hawaii should ba able to say 'thanks-but-no-thanx' to an untested  federal plan since they have demonstrated the capacity to take care of their own people.

    Medicare is going busted,
    Social Security Trust pays out more than it takes in
    A recent CBO revised report now that the bill has been passed and as Pelosi said '' we will know what's in it '' states that premiums will go up and the deficit will increase.

    Only the government could set up a business like healthcare reform. You pay now for 4 years before you start to get the services in 2014, take charge for the profits before the expenditures except for paying for another bureaucracy.

    The press and media ain't talking too much about the  HEALTHCARE REFORM BILL lately. The silence is deafening except for the business community speaking out on how the plan is unaffordable to staying in business.
    Remember what President Barack Obama said ''we need to increase the insurance pool in order to get the cost lower''.Well,17 months and unemployment went up to 9.9% recently. The people in the private sector are still looking for the jobs, President Obama.

    You on the right need to learn something....if you dish it out, you cannot demand that you not have to take it!
    Like there's some guy who jumps on every word a liberal says and demands prove it prove it...yet someone on the right can say anything, because its hyperbole.

    I think you all are so used to having everything your way, you can't even see when you are doing it!

    You who had it all for those long long 8 years should go to a deli and order a piece of humble pie....that would help the situation immensely.

    The government needs to maintain its chattel.  Health-Care is a government necessity, like changing oil on a car and other maintenance requirements.  The government is responsible for the health of its herds.  (Population)  You are PROPERTY!

    We are many court battles away from knowing what will happen and when.  Until then it's still just speculation.  The law doesn't even take full effect until 2014. There will be many changes between now and then.

      Hopefully we will move to include the public option,  if only for the Billions of dollars that cold be saved that way, according to the CBO.

      The last CBO estimate suggested savings under the new law would cut the deficit by 1.2 TRILLION in the second decade compared to doing nothing. Makes the argument for repealing insane. But I would love to increase the 1.2 TRILLION even more.
