      Thought it was a type of finch but checking it on Google images it looks like it is a - Spotted Towhee from the photo.

   Could it be a Yellow Hammer? Seems to fit the description:
   
   A small bunting (Emberiza citrinella) of Europe and western Asia having yellow plumage on the head, neck, and breast.

   rabid?  no, it was foggy and cold, that's what birds do they puff up their feathers to help stay warm.  and do birds actually get rabid?  I don't know.  You guys are going to be a big help, I can tell!

   It's a finch of some description.... looks like you just spat it out mega... did you have to play with it before you took the picture? You don't know what you might catch..

    ohhh...that's a small beaked american ruff...you can tell because of the white in the wing feathers...and his crown is not smooth....

       yep, there are and here we have a couple pairs of titmouse - titmice?  who are awfully cute and tiny with a pointy little tuft on the top of their heads.  They live in the big oak tree

          yep!  and there are at least four pairs coming to the feeder regularly.  In fact, so many birds come we have to keep going to town for birdseed - I have to find somewhere that sells it in great big bags.  Fun to watch them and they are all getting kind of fat!  I thought wild birds knew when to stop eating, but there's a little nuthatch and I counted him taking 20 seeds this morning - he flew off with most of them, probably feeding his mate.

          also I planted bachelor's buttons and some other flowers that make seeds the tiny finches love to eat!  I am trying to plant other things for them - oh and the hummingbirds come drink from the lilies and other flowers every morning and evening.  It's much better than tv!

             that's nice...attracting the butterflies too I'm sure.  I love hummingbirds.  I had the opportunity to actually pick one up once.  It was caught behind one of those glass deck panels...it couldn't figure out how to get out...so I picked it up...it was so tiny...i had to be so gentle...i let it rest on the railing...it stayed for a second or two and then it was gone....it was a nice feeling to hold a hummingbird....probably won't get a chance to do that ever again....
