What is "justice" to you?
If a man beat a woman a month and again a week before he killed her, was in jail 8 years prior to killing her for shooting people at a club, and was only out 8 months after his release, do you think that man should have been allowed to use "not guilty by reason of insanity" as his defense for a double homicide?
As of my understanding, I would say that your question was phrased incorrectly or at least described wrong. However, I will try and answer your question.
What is "justice" to you? Justice is an altruistic ideology bent on the "eye for an eye" mentality. It does not address greater problems and is ineffective at doling out punishment suitable to the crimes done.
As for your example? A man who was released from prison 8 months ago, after spending 8 years in prison for committing other violent acts, cannot use the defense "not guilty by reason of insanity", because his actions have formed a pattern of abusive behavior not common with the defense trying to be used.

The judge asks '' how do you plead'', the accused has the right to plead according to the law.
The constitution provides equal protection of the law to all citizens.
A jury is selected to listen to the testimony after which a vote is taken and a verdict is read.
The judge will render a sentence as per the law.
Sometimes guilty people get off and sad to say that sometimes innocent people are convicted.
Tthe final judgement comes to all of us when we pass away. No one ever evades the true penalty for their actions while here on earth .In the end justice will be served

We have the legal system in America but just how just is it? People are not prefect so they can not be counted on to act perfectly.
Our laws I believe can't even begin to adminster equal justice for some of the crimes committed by people today.
