Should you get a ticket for not wearing a seat belt in the back seat?

    My daughter got a ticket for not wearing her seatbelt in the backseat of a vehicle...by some officer of the law...who was just waiting under an overpass...and gathering up all that ticket revenue from this new law that's been passed.

    Is this "entrapment"...No, really though...I have yet to see a seat belt on the back of a motorcycle...and or all the back seats of a school bus!

      I would ask for a jury trial, city/county usually does not want a fight! There is a ton of reasonable doubt in a case such as this.

        I hear ya'...but if the cop does mange to show up at the trail...It's his/her word against my daughters. Still...one of those local "ticket-fighting" lawyer...might help!

          Its been my experience that the city/county will drop the charges because they do not want to go through the trouble of a jury trial, its worth a shot.

      I believe the officer was only looking out for her safety, to many times passengers are thrown from the backseats and killed which is quite sad.

      With regards to school buses they are made comepletely differently and new busses have padding to protect the child from being badly injured. There are pros and cons to seat belts on a school bus I drove one for two years and could not imagine trying to unlock 84 seat belts to get children out should there ever have been an accident, all of them could not have survived. He only did the right thing by giving her a ticket your daughter's life is precious tell her to please buckle up the next time, just my opinion. smile

        Hi names Jason im 15 years old and ride the bus every day to school. I just want you to know that some buses are not so safe. There are some schools that dont have the money for safer buses. The bus i ride dose not have seat belts and im glad for that but they should have them on the buses for the people who think they should.

      Is it entrapment?  Go to court and find out.  Just like in CA it doesn't apply to motorcycles and buses.  Should it?  maybe as far as safety goes it should but motorcycles pay different insurance rates just because of that so don't sweat that.

    MPM congrats on the 100! and I think that seatbelts definitely need to be added to buses. that could save lives I think. But truthfully I do think getting a ticket in the backsea of a car is a bit extreme...a warning would be fine for the first time but then if it happens again then a ticket.

      Thanks Crazd...this country is becoming unsafe to drive in daily...if you don't get side-swiped by someone who doesn't know what "merge" or "drivers ed" means...then you get oulled over for something really stupid...emphasis on "really stupid".

            heck yea...then going to work wouldn't be such a drag to a lot of ppl and because the cars are smaller, less gas and less traffic possibly hehehe

                hehehe I could see you doing that MPM. there would be no car accidents and no deaths. it would be just us driving around, "accidently" bumping into each other as we drive. It would be great! hmmm...maybe I should write a short story where ppl drive bumper cars big_smile

                  Yes...you should write a hub on it lol and not only that...but it would be all electric cars...like you said...great for the enviroment...and great for the frustrations of day-to-day driving! You could come home LAO instead of streesed to the max, too! However....the Auto Body shops may protest.

    The "seat-belt" laws in the U.S. were purported by emotional people who were manipulated by the influences of advocate groups with their own agenda about carving/separating citizens, so more individual choice could be stripped away from people in general.

    The "seat-belt" law is an invasion of a person's right to choose.

    As for your daughter- the law stipulates anyone not wearing a seat-belt is to be fined, regardless of whether or not, it is their vehicle.

    This ticket is not a criminal violation, but a civil one. However, it will count on insurance premiums and towards the use of licenses(should she get more violations), which can force the State government the ability to strip her of her ability to drive.

    Just thought I would throw that out there. smile

      I don't see what emotion has to do with acting responsibly.  Why should I suffer financially for another person's poor choices?  Not wearing a seatbelt in a moving vehicle is a ridiculous choice to make.  I would defend your right to make that choice if you could absolve me of any consequences as a result of it.

        What does responsibility have to do with driving a car?

        Driving a car is a ability taught. Either by parents or schools. There is no correlation between a seat-belt and one's ability to drive said vehicle.

        Ridiculous? It's freedom. And, as far as, YOU suffering financially because of it, isn't due to the irresponsibility of people who don't wear their seat-belts, it is caused by the irresponsibility of those who drive, which causes accidents that drive up rates.

        It isn't my duty to absolve you of any consequences? Nor, could I, should YOU do something wrong.

        In case you didn't know- it is the people who have emotional attachments to dead family members, for which, advocate new laws to strip people of their individual freedom of choice.

        When you get into a vehicle, it is a choice to drive it somewhere and it is a choice to wear a seat-belt. The seat-belt itself has NOTHING to do with one's ability to drive the vehicle.

        But, I do appreciate your side. Thank you for your input. smile

      Your right about much of this...but I believe it was the dang insurance companies that lobbied this one through...if they' have their way they'd have us leaving in cocoons...and still paying them crazy amounts of insurance fees!

        Most people who are killed in car accidents that are wearing a seat belt, are killed by people in the car that are not wearing one. So, the person in the back seat that doesn't wear their seatbelt can kill the person in the front seat who decided to wear theirs. So, this law protects the person that does want to live.

        Personally I don't care if people in the backseat don't want to wear seatbelts- as long as they are not behind me! If there were an accident, it would be the person in front of her who would probably die, so it is  a wee bit selfish. Anyway, thats just my opinion!

    I dont know about a ticket...but if someone riding in my cars backseat fails to buckle up, then kills me with thier flying body in a car accident, I will haunt them.  smile

    If you ask me, no tickets should exist at all. If you caused any real harm to others, you are responsible for the damage - by court ruling. Otherwise you are free to do what you please. smile

    Here in Australia it is the law that everyone in the vehicle must wear one (there are no options not to wear one) or you will receive a huge fine. Plus they are cracking down on it even more lately I hear the fine is going up after yet more road fatalities where people died from not wearing seat belts.

    Back in the day (as they say) I did not wear one. Then I went to police driving instructors school and now I ALWAYS wear it. It can/will save your life. If someone behind you is not wearing one and you hit a tree at say 45, guess where they are going?

    A warning may have sufficed, but maybe the cop has thrown a blanket over too many to just let it go.

    here's my beef motorcycles don't have seat belts. and in my state they dont have to ware a helmet . so wheres the fairness . i hate seat belt laws but i still ware one beacuse i know and have seen that a car will kill you.

    LOL - The seat Belt law was brought in not to save lives but for police to have yet another reason to stop ya to see if you are drinking and to justify their high salary by bringing in yet another income stream .  Let's face it - every ticket handed out is an income stream to bring cash to the over burdened public sector. Crap! -- I love N.America for the freedoms we "used" to have!

    In Alberta, Canada where i live the seat belt law has been in place for around 20 years already.

    It has been proven to save many lives in accidents.

    trust me you just get used to using it and it becomes second nature just like turning the key in the ignition.

    Much bigger things in life to fret about then putting on a seatbelt.
